These Terms of Use (“Terms”) govern your access to and use of the GigaClean mobile application (“App”) and the website at gigaclean.pro (the “Site”), operated by CARACCIOLO SRL (“we”, “us”, “our”). By using the App or Site, you agree to these Terms. If you do not agree, do not use our services.

1. The service

GigaClean helps you review and manage photos, videos, screenshots, and related storage on your iPhone. Features may include duplicate detection, storage insights, and optional tools such as battery health, ad blocking, device security, or email leak checks, as described in the App. Availability of features may vary by device, iOS version, and subscription status.

The Site includes an informational quiz. Quiz results are based on your answers and do not scan or access your device. Actual cleaning and file review occur only after you install and use the App on your iPhone.

2. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) and able to form a binding contract. You are responsible for compliance with local laws.

3. Apple App Store

The App is distributed through the Apple App Store. Your download and use of the App are also subject to Apple’s applicable terms and policies. Apple is not a party to these Terms and is not responsible for the App or its content.

4. Subscriptions and purchases

Some features require a paid subscription or in-app purchase. Prices, billing period, and trial terms are shown in the App before purchase. Payment is processed by Apple. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period in your Apple ID settings. Refunds are handled by Apple according to its policies.

5. Your content and permissions

You retain ownership of your photos, videos, and other files. You grant us the limited permission needed to provide the App on your device (for example, accessing the photo library only when you initiate a feature). You are solely responsible for reviewing items before deletion and for maintaining backups.

Important: Deleting files in the App may be permanent. We are not liable for loss of data resulting from your actions or device failures.

6. Acceptable use

You agree not to:

• Use the App or Site for unlawful purposes
• Reverse engineer, decompile, or attempt to extract source code except where permitted by law
• Interfere with or disrupt our services or security measures
• Misrepresent your identity or affiliation
• Use automated means to access the Site in a manner that imposes unreasonable load

7. Intellectual property

The App, Site, trademarks, logos, and content (excluding your files) are owned by us or our licensors and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App and Site for their intended purposes in accordance with these Terms.

8. Disclaimers

The App and Site are provided “as is” and “as available”. We do not guarantee that the App will find every duplicate, free a specific amount of storage, or that optional tools (including security or leak checks) will detect every issue. Results are estimates and aids for your review, not professional advice.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by applicable law, CARACCIOLO SRL and its affiliates, officers, and employees will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the App or Site.

Our total liability for any claim relating to the App or Site shall not exceed the greater of (a) the amount you paid us for the App in the twelve months before the claim, or (b) EUR 50, except where liability cannot be limited under mandatory law.

10. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your misuse of the App or Site, your content, or your violation of these Terms, except to the extent caused by our intentional misconduct or gross negligence.

11. Changes

We may modify the App, Site, or these Terms. We will post updated Terms on this page. Continued use after changes become effective constitutes acceptance, where permitted by law.

12. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate access if you violate these Terms or if required for legal or security reasons.

13. Governing law

These Terms are governed by the laws of Italy, without regard to conflict-of-law rules, except where mandatory consumer protections in your country of residence apply. Courts in Italy shall have exclusive jurisdiction where permitted; consumers in the EEA may also have rights to bring claims in their country of residence.
